Karnataka to seek view of prosecutor before moving Supreme Court
The Karnataka government would decide on filing an appeal in the apex court against the acquittal of the former Tamil Nadu CM only after knowing Special Public Prosecutor B V Acharya’s opinion on the matter.
The Karnataka government, the prosecution in the illegal assets case against AIADMK chief J Jayalalithaa since the case was transferred to the state in 2003 by the Supreme Court, would decide on filing an appeal in the apex court against the acquittal of the former Tamil Nadu CM only after knowing Special Public Prosecutor B V Acharya’s opinion on the matter.

Acharya, who was reappointed as the SPP in the case on April 28, said he would first go through the judgment before giving any suggestion on the matter.

“Normally, in most criminal cases the higher court always upholds the judgment of the lower court. In this case things have turned out differently,” Acharya said, indicating that he was “waiting to study the judgement to advise” the Congress government on further steps in the case.

The Karnataka government had played an active role as the prosecution in the case since Siddaramaiah came to power in 2013 by seeking to replace the then SPP Bhavani Singh, appointed by Tamil Nadu, after he was accused in court by DMK of favouring Jayalalithaa and her associates. Singh was appointed by HC as SPP during the BJP government’s tenure in the state.

The original complainant in the case, BJP leader Subramanian Swamy, said if the Karnataka government fails to appeal then he would appeal on behalf of the prosecution.
