Himachal Pradesh: HC stays I-T proceedings against Virbhadra

In a major relief to Chief Minister Virbhadra Singh, the Himachal Pradesh High Court Thursday stayed the proceedings initiated by the Income Tax department into his I-T returns, mainly relating to revised tax returns of years 2009 to 2012.
The court has given two weeks time to the I-T department to reply in the case. The I-T department had sent two notices to the Chief Minister for revised income tax returns, which have showed increase in his farm income.
The Division Bench passed the orders on a petition filed by Singh challenging the notices on the ground that the I-T department had erred in issuing notice for reassessment on the basis of revised returns maintaining that the agricultural income was non-taxable and thus no notice could be issued to him under the Income Tax Act.

Singh, in his original I-T return filed for 2009-2010, had declared taxable income of Rs 17.08 lakh and an agriculture income of Rs 7.35 lakh. The agricultural income for 2009-10 was later revised to Rs 2.21 crore.
